A building tied to a single use permit and short on parking, sold to the owner of the property next door — the one buyer already operating under the same conditions.

The Assignment:

A local attorney referred us to the owners of 1942 Linda Drive after their child care tenant vacated. We had known the sellers for years but had never represented them. The property is a ±2,500 SF freestanding retail building on ±0.17 acres, rebuilt in 2005, directly behind Casper’s off Contra Costa Boulevard in Pleasant Hill.

The building operated under a conditional use permit for child care serving up to 30 students, and the site is deficient on parking under current code. Any occupant outside that entitlement would have to carry a new use through the City with a parking shortfall already on record. That removed most of the buyer pool before the property went to market.

The Transaction:

The buyer was the owner of the adjoining property — a building we had sold him several years earlier. He was already operating successfully under the same ordinance, understood the parking condition, and had been looking to relocate into the larger building next door.
